The rule the IRS actually states
An ITIN is issued to an individual who needs a U.S. taxpayer identification number for a federal tax purpose and is not eligible for a Social Security number. Being listed as a partner on Form 1065 is not by itself a federal tax purpose. The IRS says so directly in its guidance on what can be entered on Schedules K-1 and K-3 in place of a TIN: a foreign partner who is not required to file a U.S. return and has no U.S. tax obligation is not required to obtain a TIN merely because the partnership files. The partnership return is still complete without it, provided the partner is properly identified.
When a foreign partner does need one
The answer flips when the partner has their own U.S. tax event. Common triggers: the partnership is engaged in a U.S. trade or business and allocates effectively connected income to the partner, which creates a Form 1040-NR filing obligation and section 1446 withholding reported on Form 8805; the partner wants to claim a treaty rate on U.S.-source income; the partner sells the partnership interest and section 1446(f) withholding applies; or the partner must be listed with a TIN on a withholding certificate such as Form W-8BEN for a treaty claim. In those cases the partner applies on Form W-7 under the relevant exception, and since June 1, 2026 a Certifying Acceptance Agent filing under the partnership-interest exception must attach the supporting partnership documentation.
How to complete the K-1 without a TIN
There are two mechanics, and they are not interchangeable. In an authorized e-file transmission, the IRS permits 000-00-0000 in the TIN field of Schedule K-1 or K-3 for a foreign individual who is not required to obtain a TIN. On a paper return, do not use zeros or any placeholder: leave Item E blank and attach a statement identifying the partner by name, address, and country and citing the IRS guidance for why no TIN is required. Never invent a number, and never use one partner's number for another. The IRS matches K-1s to taxpayer accounts, and a fabricated TIN is a false statement on a signed return.
The ITIN mistakes that cost months
Applying for an ITIN without a tax purpose is the most common error: the W-7 is rejected or sits for the eight to sixteen weeks that mail applications currently take, while the Form 1065 deadline passes. Waiting to file the partnership return until ITINs arrive is the second: the return does not depend on them. Third is attaching a Form W-7 to Form 1065; a W-7 is filed with the applicant's own return or under a stated exception, not with the partnership return.
