Content Creator & Influencer TaxAnswered

My Instagram sponsorship contracts let U.S. brands reuse my content. Is that just service income?

I am a Brazilian influencer using a New Mexico LLC for brand partnerships. Most campaigns are for U.S. beauty brands and I usually shoot everything in Sao Paulo, but the contract often says the brand can reuse the content in paid ads for the U.S. market for six months. My annual revenue is about $130,000.

I keep hearing that service income depends on where the work is performed, which sounds like Brazil in my case. But I am worried the U.S. ad usage rights make the payments partly something else.
