Key Takeaways
- TY2026 draft Forms 5472, 1120, and 1065 are published; final forms are not
- Monitor irs.gov/draft-tax-forms, and the About Form 5472 / About Form 1120 pages
- The draft Form 5472 is labeled Rev. December 2026 and is not identical to the current form
- Current Form 5472 instructions still cover the December 2023 revision; watch for TY2026 instructions
- For catch-up filings, use the form revision that was current for that tax year — not the latest version
TY2026 Drafts Are Already Published
Status checked September 1, 2026: the IRS has posted early-release drafts of Form 5472 (Rev. December 2026, June 2), Form 1120 (June 1), Form 1065 (July 17), Schedule K-1 (May 21), Schedules K-2 and K-3 (June 17), Form 8804 (Rev. December 2026, June 9), Form 8832 (December 2026, May 20), Form SS-4 (December 2026, July 27) and Form 1042 (April 30). The currently published Form 7004 is Revision December 2025 and Form W-7 is Revision December 2024. Recheck the IRS form pages before filing; absence of a newly posted draft does not guarantee that no revision will follow. Forms 1099-NEC, 1099-MISC and 1099-K at Revision December 2026, the 2026 Form 1099-DA and the 2026 Form 1042-S are already final.
These are planning documents, not fileable returns. Final TY2026 forms and instructions are still expected later in 2026 or early 2027, but the IRS does not promise a publication date. Watch the draft directory for revisions and the latest-forms directory for the final release.
Where to Watch
Three IRS pages to bookmark for TY2026 foreign-owned LLC filers:
1. irs.gov/draft-tax-forms — every draft in one sortable index. Use the filter to find "5472" or "1120" directly. 2. irs.gov/forms-pubs/about-form-5472 — official status page for Form 5472. The "Recent developments" section lists the current revision and any new postings. 3. irs.gov/forms-pubs/about-form-1120 — the same for Form 1120. This page also lists related schedules that sometimes update ahead of the main form.
Do not rely on tax news aggregators, TurboTax blog posts, or third-party summaries for release dates. They are often incorrect or delayed.
Form 5472 Has a December 2026 Draft Revision
The IRS has now answered the revision question: the draft is labeled Form 5472 (Rev. December 2026). Compared with the current December 2023 form, it expands the customs-value questions in Part VII, updates section 250 terminology, restructures address fields, and changes some PDF field paths.
The current public instructions remain Rev. December 2024 and refer to the December 2023 form. Do not assume draft questions, field names, filing mechanics, or instructions are final until the IRS posts the approved TY2026 products.
What ForeignLLCTax.com Tracks
We monitor irs.gov/draft-tax-forms and the About pages for Form 5472 and Form 1120 on a regular schedule. When TY2026 drafts appear, we diff the field layout against the current templates stored in our repo and identify any new lines, removed lines, or renamed fields. When finals release (typically December), we update the PDF templates and field-position mappings so the wizard generates current-year returns.
For catch-up filings (users who missed TY2023 or TY2024 deadlines), we keep the prior-year templates available — the IRS accepts late filings on the form revision that was current for that tax year. Always match form revision to tax year, never the other way around.
Frequently Asked Questions
When do TY2026 forms become available on irs.gov?
Draft Form 1120 was posted in early June 2026, draft Form 5472 on June 2, and the current draft Form 1065 on July 17. Final TY2026 versions are not yet published as of August 12, 2026.
Can I use a draft form to file early?
No. The IRS explicitly marks draft forms as not for filing. Submitting a return on a draft form is treated as a substantially incomplete filing, which triggers the $25,000 Form 5472 penalty.
Where do I check for Form 5472 updates?
The official status page is irs.gov/forms-pubs/about-form-5472. It shows the current revision date and any recent developments. For advance drafts, check irs.gov/draft-tax-forms and search for "5472".
Is there a new Form 5472 revision for 2026?
There is an early-release draft labeled Rev. December 2026. It is not final and cannot be filed. The current approved Form 5472 remains Rev. December 2023 until the IRS releases the final replacement.
